TITLE VI (NON-DISCRIMINATION)

It is the City of Poulsbo’s policy to ensure full compliance with Title VI of the Civil Rights Act of 1964 by prohibiting discrimination against any person on the basis of race, color, or national origin in the provision of benefits and services under any programs and activities. Any person who believes his/her Title VI protection has been violated, may file a complaint (link to the Title VI – Complaint form) with the City of Poulsbo. City of Poulsbo Policy Statement:
The City of Poulsbo assures that no person shall on the grounds of race, color, or national origin as provided by Title VI of the Civil Rights Act of 1964 as amended, and the Civil Rights Restoration Act of 1987 (P.L. 100.259) be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity. The City further assures every effort will be made to ensure non-discrimination in all of its programs and activities, whether those programs and activities are federally funded or not.

The Civil Rights Restoration Act of 1987, broadened the scope of Title VI coverage by expanding the definition of terms “programs or activities” to include all programs or activities of Federal Aid recipients, sub-recipients, and contractors/consultants, whether such programs and activities are federally assisted or not (Public Law 100259 [8.557] March 22, 1988.)

In the event the City of Poulsbo distributes federal aid funds to a sub-recipient, the City of Poulsbo will include Title VI language in all written agreements and will monitor for compliance.

The City’s Human Resources Manager and Engineering Director are responsible for initiating and monitoring Title VI activities, preparing reports, and other responsibilities as required by 23 Code of Federal Regulation (CFR) 200 and 49 Code of Federal Regulation 21.

Discrimination Complaints – How to File a Complaint of Discrimination

Who can file a Title VI complaint?
Any person or group who believes they were discriminated against based on race, color, or national origin in programs, services, or activities where there is federal assistance may file a Title VI complaint.

Complaints related to the federal-aid highway program may be filed with The City of Poulsbo, WSDOT, FHWA Division Office, the FHWA Headquarters Office of Civil Rights (HCR), the USDOT Departmental Office of Civil Rights, or the United States Department of Justice. According to USDOT regulations, 49 CFR §21.11(b), a complaint must be filed no later than 180 days after the date of the last instance of alleged discrimination, unless the time for filing is extended by the processing agency.

How do I file a complaint?
Complaints should be in writing, signed, and filed by mail, fax, in person, or e-mail. If a complainant phones the City with allegations, the City will transcribe the allegations of the complaint as provided by phone and then send a written complaint to the complainant for correction and signature. In the case where a complainant is unable or incapable of providing a written statement, a verbal complaint of discrimination may be made to the Title VI Coordinator. Under these circumstances, the complainant will be interviewed, and the Title VI Coordinator will assist the complainant in reducing the verbal complaint to writing and submit the written version of the complaint to the complainant for signature.

A complaint must contain the following information:

  • The complainant’s contact information, including: full name, mailing address, phone number (and best time to call), email address (if available);
  • The basis of the complaint (e.g., race, color, national origin);
  • The names of person(s) and/or agency/organization alleged to have discriminated.
  • A description of the alleged discriminatory actions (include sufficient information to understand the facts that led the complainant to believe that discrimination occurred in a program or activity that receives federal financial assistance); and,
  • The date(s) of the alleged discriminatory act(s) and whether the alleged discrimination is ongoing.

Annual Accomplishment Reports

Annually, the City of Poulsbo prepares a report of Title VI accomplishments for the preceding year and goals for the following year.

The report lists major accomplishments made regarding Title VI activities and includes instances where Title VI issues were identified and discrimination was prevented; highlights the activities and efforts that the Title VI Coordinator and program area personnel have undertaken in monitoring Title VI; describes the scope and conclusions of any special reviews (internal or external) conducted by the Title VI Coordinator; lists any major problem(s) identified and corrective action taken; and includes a summary and status report on any Title VI complaints filed with the recipient.
